Summer Hacks Competition

Terms & Conditions of Entry

1. Information on how to enter, eligibility and the prize associated with the Summer Hacks Competition (Competition) forms part of these Terms and Conditions. Participation in this Competition is deemed acceptance of these Terms and Conditions.  The Competition is run by Ergon Energy Queensland Pty Ltd ABN 11 121 177 802 (Ergon Energy).
2. The Competition commences on Monday 2 December 2024 at 8:00am and closes at 5pm Australian Eastern Standard Time (AEST) on Friday 28 February 2025 (Competition Period). Entries outside the Competition Period will not be accepted.
3. The Competition is open to Ergon Energy residential customers who are 18 years or older and have an active Ergon Energy residential electricity account using less than 100 megawatt hours of electricity per year.
4. Employees of Ergon Energy and its related and associated entities, their immediate families together with agencies and/or companies associated with this promotion are ineligible to enter the Competition. For this purpose, immediate family includes, but is not limited to, spouses, defacto spouses, parents, natural or adopted children and siblings (whether natural or adopted by a parent).
5. All entries are to be submitted via the Ergon Energy Retail Facebook page www.facebook.com/ErgonEnergyRetail and/or the Ergon Retail Instagram page: www.instagram.com/ergonretail.  To be eligible to enter the competition, you must perform task 5.1. as well as task 5.2 and/or 5.3:
   1. Like the Ergon Energy Retail Facebook or Instagram page (Our Pages); and
   2. Comment with your best energy-saving summer hack on the Ergon Energy Retail Facebook or Instagram Summer Hacks posts; or
   3. Post a video with a summer hack to bust those summer energy bills, tagging Ergon Energy Retail on either Facebook or Instagram.
6. When you submit comments, images, audio, videos or other material (User Content) to any of Our Pages, you grant to us, a non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable licence to use, reproduce, modify, adapt, publish or communicate to the public your User Content for the reasonable purposes of our business. You also consent to any act or omission that would otherwise infringe any of your rights (including your moral rights) in your User Content.
7. You warrant that you have the right to grant the above licence, that our exercise of the licence rights above will not infringe the intellectual property rights of any person, and that the User Content is not defamatory and does not breach any law.
8. Ergon Energy reserves the right to remove any entry from Our Pages if we are of the opinion that the entry is:
   1. a risk to the operational integrity of our services;
   2. is likely to defame, harass, threaten, menace or offend any person;
   3. contains any offensive material;
   4. contains content that is commercial in nature; or
   5. otherwise breaches any law.

Any entry removed by Ergon Energy under this section will no longer be eligible to win a prize.

9. By entering the Competition, you agree to Ergon Energy’s Social Media Community Guidelines.
10. Ergon Energy reserves the right to administer the Competition and to alter these terms and conditions (including the prize and winner selection terms) for any reason and at its absolute discretion.
11. To the extent permitted by law, Ergon Energy and its related bodies corporate disclaim any and all warranties and representations of any kind and all liability (including for negligence) for any loss or damage arising out of, or in connection with, your participation in this Competition. You agree to indemnify us from and against all actions, claims, damages, liabilities, costs or expenses arising out of or in any way connected to the use of Our Pages by you.
12. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering the Competition, you release Facebook from any and all liability arising in connection with the Competition.
13. This Competition is in no way sponsored, endorsed or administered by, or associated with, Instagram. By entering the Competition, you release Instagram from any and all liability arising in connection with the Competition.

Prize and winner selection

14. Ergon Energy will select up to a total of twelve (12) winners of the Competition, based on the creativity of their comments and video posts in relation to their best summer hack bill busting tip. This is a game of skill and chance plays no part in determining the winner. The twelve (12) winners will be made up of six (6) winners per channel (Facebook and Instagram) and will consist of a monthly winner for the best comment or the best video. However, Ergon Energy retain the right to change the prize draws at their sole discretion.
15. Each winner will receive a credit to their Ergon Energy electricity account. The prize amount will be dependent on the submission type. Entries submitted under clause 5.2. will be eligible for a $50 credit to their electricity account. Entries submitted under clause 5.3 will be eligible for a $500 credit to their account. There will be monthly prizes drawn for best comment and best video on both Facebook and Instagram. Prize draws will occur in December 2024, January 2025 and February 2025.
16. The prize is not transferable or exchangeable.
17. Ergon Energy Retail will seek to contact the participant by direct message to verify their information and arrange a credit to be applied to the appropriate account.
18. Each winner consents to having their name published on Ergon Energy Retail’s promotional channels, including but not limited to social media, email, web and newsletters.
19. Ergon Energy Retail’s decision with respect to the selection of winners is final and binding and no correspondence will be entered into.

Privacy notice

Ergon Energy is collecting your personal information for the purpose of administering the Summer Hacks Competition. This collection is protected under the Privacy Act 1988 (Cth). Your personal information will not be passed on to any other third parties, unless authorised or required by law or with your consent. By entering the Summer Hacks competition, you expressly consent to the disclosure of your name on Ergon Energy Retail’s promotional channels, including but not limited to social media, email, web and newsletters. If you do not provide all or some of the information, we may not be able to enter you into the competition.
